The Individual Mandate and Obamacare
Consider the the widely unpopular individual mandate (http://www.prnewswire.com/news-releases/individual-mandate-in-health-care-reform-law-still-widely-unpopular-poll-117146333.html) and whether it is considered a penalty or a tax.
DOJ has argued that it IS a TAX and therefore IS constitutional through the use of commerce clause.
However, it appears that the six judges that have weighed in on this as of March 1, 2011 (3 for and 3 against) that they ALL agree that the individual mandate is NOT a tax (http://www.redcounty.com/content/legal-fate-obamacare-may-boil-down-tax-issue), even the ones that sided favorably to uphold the individual mandate.
This may have a bearing if this challenge gets to the Supreme Court and the individual mandate could be struck down as unconstitutional and thereby since there is not serverability from this and the entire law, Obamacare will then be deemed nullified.

The left ideology is presently NOT the majority in our country as evidenced by the recent November 2010 midterm elections….
80% of us are to the “right of left”…

Recognize that the mainstream media along with the unions are bought and paid for by this administration. This will not change since their cover is now blown.
Let us hope that voters remember this and will again show their resolve in November 2012.
