Dear Friends:
The state “Obamacare exchange” issue is heating up; here’s a report:
First, legislators are hearing from Tea Party members and sympathizers in their own districts, and your voices are having an impact. You are moving the needle!

The Governor, state bureaucrats and insurers have good “technocratic” reasons for wanting to get an early start on creating a state Obamacare exchange. They cannot assume the law will be struck down or repealed. This is what lawmakers are hearing every day in Lansing.

That’s all understandable, although it’s not honest for them to soft-pedal this as being “like Orbitz and Travelocity.” In fact it will be a large and powerful new government bureaucracy. Specifically, this will be the agency that administers Obamacare’s mandates, subsidies, regulations and rationing.

However, the people have a more compelling priority, which is to see Obamacare repealed or invalidated. We want lawmakers to share that priority, but creating an exchange now undermines it, because it helps further entrench the law. I shared six bullet points explaining how here.

Therefore, our message is, if Obamacare survives the Supreme Court (“SCOTUS”) next June and the voters (“VOTUS”) in the Nov. 6, 2012 presidential election, there will be time enough then to create an exchange.

The other side responds that it will be better for Michigan if we create our own exchange, rather that the alternative of letting the feds create one for us. Further, under the law, if we are not well along in that process by 1/1/13, the feds will move in. Finally, the feds are handing out huge grants every three months for states to create exchanges (with lots of strings attached).

For various reasons, the “do it by 1/1/13″ threat is not credible. Probably due to the irregular way it was passed, the Patient Protection and Affordable Care Act fails to authorize any funding for federal exchanges. It also fails to authorize payment by the federal exchanges of the insurance subsidies that are the heart of Obamacare. In short, without further grants of authority by congress – including the Republican House – the federal government is not capable of creating and operating state exchanges by 1/1/13.

Also, Michigan will have the company of many other states if we don’t have an exchange on 1/1/13. Several governors have refused to create a state exchange, and ours is not the only legislature hesitating.

The politicians and bureaucrats in Washington know this, and that’s why they are so eager and willing to help states create their own Obamacare exchanges. This will not change on 1/1/13 (assuming the law survives the Supremes, and the President is reelected).

Therefore, legislators who choose to wait now are not taking a wild gamble, but instead are being prudent, and putting the priorities of their constituents ahead of other interests.

Bottom line: We’re not saying “Hell No!” We are saying, prudent legislators would be wise to ignore the false sense of urgency being generated by exchange supporters now.

It’s worth boning up just a little, to prevent people from being confused by politicians trying to pre-empt negative public reaction if they end up voting “yes” for an exchange this fall. Most Republicans are undecided, which is an opportunity for grass-roots Obamacare opponents.
